Amy Bilton and Timothy Mercer to Discuss MSP Updates at MSPN 2025 Annual Educational Conference

Nyhan’s Vice President Amy Bilton and Paraprofessional Timothy Mercer will share their insights at the National Medicare Secondary Payer Network (MSPN) 2025 Annual Educational Conference taking place from October 15 – 17 at the Hotel at Arundel Preserve in Hanover, Maryland.

Amy will moderate the program, “There’s No Place Like Home: Understanding State Law,” from 2:15 – 3:15 p.m. ET on Wednesday, October 15. The panel will discuss how state law intersects with federal MSP obligations with topics such as:

  • How compensability and future medical treatment state laws affect MSP practices.
  • When and how state laws can justify zero-dollar MSAs or reduced allocations.
  • The Centers for Medicare & Medicaid Services’ expectations for documenting medical necessity and treatment limitations under state law.
  • Aligning Section 111 reporting with state-specific settlement terms and medical obligations.
  • Strategies for defending MSA decisions and Conditional Payment disputes using state law as a foundation.

Tim will join both parts one and two of the session, “Follow the Yellow Brick Road to Conditional Payment Resolutions,” on Wednesday, October 15 from 1:00 – 2:00 p.m. ET and 2:15 – 3:15 p.m. ET, respectively. Tim will discuss Section 111 reporting and how it relates to conditional payments and Workers’ Compensation Medicare Set-Aside review process including:

  • The roles of the Commercial Repayment Center, Benefits Coordination and Recovery Center, and U.S. Treasury.
  • Appeal and repayment options, including self-calculated and fixed-percentage liability approaches.
  • Medicare Advantage Plan recovery and considerations for payment and appeals.
